Nearby is a discovery platform operated by Binyuga that enables users to discover professionals listed on the platform in and around their location, and to obtain such professionals' contact details in order to connect with them directly. Nearby is a discovery and directory platform only.
By downloading, accessing, or using Nearby, you agree to these Terms, our Privacy Policy, and any applicable app-store terms. If you do not agree, do not use the platform.
3.1 Nearby is not a party to any engagement between a user and a professional. Professionals listed on Nearby are independent third parties. Binyuga is not an employer, agent, partner, representative, insurer, or guarantor of any professional, and no listing constitutes an endorsement, certification, verification of qualification, or recommendation by Binyuga or the Administrator.
3.2 Direct engagement. All dealings, communications, arrangements, payments, services, and outcomes between a user and a professional occur directly between them. Any contract for services is strictly between the user and the professional.
3.3 No responsibility for interactions. Binyuga, the Administrator of Nearby, and the shareholders, directors, officers, and employees of Binyuga shall not be responsible or liable in any manner for any act, omission, conduct, representation, quality of work, delay, loss, damage, injury, fraud, dispute, or any other occurrence arising out of or in connection with any interaction, engagement, or transaction between a user and a professional, whether online or offline. All such dealings are undertaken by users and professionals entirely at their own risk and responsibility.
3.4 Users are solely responsible for exercising their own judgment, conducting their own verification (including identity, qualifications, licences, and references), and taking appropriate precautions before engaging any professional.
4.1 You must provide accurate information and keep your account credentials secure.
4.2 You agree not to: (a) misuse the platform or the contact details obtained through it, including harassment, spam, or unsolicited marketing; (b) post false, defamatory, obscene, or unlawful content; (c) scrape, reverse-engineer, or misuse platform data; (d) use Nearby for any unlawful purpose.
4.3 We may suspend or terminate accounts that violate these Terms.
5.1 The review section is open for users to share experiences. Content posted is the sole responsibility of the person who publishes it.
5.2 The publisher of any review or content is solely and personally responsible for its accuracy, lawfulness, and non-infringement, and for any claims (including defamation) arising from it. By posting, the publisher represents that the content is their genuine experience and opinion, made in good faith.
5.3 Binyuga does not pre-verify reviews and is not responsible for their content. However, Binyuga may (but is not obligated to) remove content that violates these Terms, applicable law, or a valid legal order.
5.4 You grant Binyuga a non-exclusive, royalty-free licence to host, display, and distribute your content on and in connection with Nearby.
The Nearby name, logo, software, and platform content (other than user content and professional listings) are the property of Binyuga or its licensors and may not be used without written permission.
To the maximum extent permitted by law, Nearby is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. We do not warrant that any professional is qualified, licensed, insured, available, or suitable for your needs.
To the maximum extent permitted by law, Binyuga Private Limited, the Administrator of Nearby, and its shareholders, directors, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or personal injury — arising from or related to your use of Nearby or any interaction with any professional. Nothing in these Terms excludes liability that cannot be excluded by law.
You agree to indemnify and hold harmless Binyuga, the Administrator, and its shareholders, directors, officers, and employees from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of Nearby, your content or reviews, or your dealings with any professional — except to the extent caused by Binyuga's own breach or wilful misconduct.
We may modify these Terms from time to time. Continued use after the updated Terms are posted constitutes acceptance.
These Terms are governed by the laws of India. Subject to applicable law, the courts at Chhatrapati Sambhajinagar, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with Nearby or these Terms.
